Najemodajalec je naveden v glavi tega dokumenta. Najemnik je naveden v zgornjem delu dokumenta.

The lessor is stated in the header of this document. The renter is stated in the upper part of this document.

2. Predmet najema / Subject of rental

Najemodajalec daje najemniku v najem kolo oziroma električno kolo, ki je označeno in navedeno v tem dokumentu oziroma v spremljajoči najemni dokumentaciji.

The lessor rents to the renter a bicycle or an electric bicycle, which is marked and listed in this document or in the accompanying rental documentation.

3. Trajanje najema / Rental period

Najem velja od dogovorjenega datuma in ure prevzema do dogovorjenega datuma in ure vračila. Morebitno podaljšanje najema je možno samo po predhodnem dogovoru z najemodajalcem.

The rental is valid from the agreed pick-up date and time until the agreed return date and time. Any extension of the rental period is possible only by prior agreement with the lessor.

4. Prevzem in vračilo kolesa / Pick-up and return

Najemnik prevzame kolo na dogovorjeni lokaciji in ga mora vrniti na isto lokacijo, razen če je pisno ali ustno dogovorjeno drugače.

The renter picks up the bicycle at the agreed location and must return it to the same location, unless otherwise agreed in writing or verbally.

5. Identifikacija najemnika / Renter identification

Najemnik mora ob prevzemu kolesa predložiti veljaven osebni dokument. Najemodajalec lahko za čas trajanja najema evidentira potrebne podatke zaradi preverjanja identitete, preprečevanja zlorab ter zaščite premoženja višje vrednosti.

The renter must present a valid identification document upon pick-up. For the duration of the rental, the lessor may record the necessary data for identity verification, prevention of misuse and protection of high-value property.

6. Uporaba kolesa / Use of the bicycle

Najemnik je dolžan kolo uporabljati skrbno, odgovorno in v skladu z njegovim namenom. Kolo mora varovati pred poškodbami, izgubo, krajo in drugimi tveganji. Uporaba kolesa za nezakonite, nevarne ali neprimerne dejavnosti ni dovoljena.

The renter must use the bicycle carefully, responsibly and in accordance with its intended purpose. The renter must protect the bicycle against damage, loss, theft and other risks. The use of the bicycle for illegal, dangerous or inappropriate activities is not permitted.

7. Odgovornost za škodo / Liability for damage

Najemnik odgovarja za vso škodo, ki nastane na kolesu v času najema, razen za običajno obrabo, ki nastane pri pravilni uporabi.

V primeru poškodbe kolesa najemodajalec oceni stroške popravila, ki jih je najemnik dolžan poravnati ob vračilu kolesa oziroma po izdani specifikaciji stroškov.

V primeru popolnega uničenja, izgube ali kraje kolesa je najemnik dolžan poravnati vrednost kolesa po njegovi takratni tržni vrednosti.

The renter is responsible for any damage caused to the bicycle during the rental period, except for normal wear and tear resulting from proper use.

In case of damage, the lessor shall assess the repair costs, which the renter must settle upon return of the bicycle or after receiving the cost specification.

In case of total destruction, loss or theft of the bicycle, the renter must reimburse the value of the bicycle according to its current market value.

8. Kraja ali izguba kolesa / Theft or loss of the bicycle

V primeru kraje ali izgube kolesa mora najemnik o tem takoj obvestiti najemodajalca in krajo prijaviti policiji. Najemnik mora najemodajalcu predložiti policijski zapisnik oziroma dokazilo o prijavi dogodka.

In case of theft or loss of the bicycle, the renter must immediately inform the lessor and report the theft to the police. The renter must provide the lessor with a police report or proof of the reported incident.

9. Zavarovanje / Insurance

Če najemodajalec omogoča dodatno zavarovanje za primer poškodbe ali kraje kolesa, ga lahko najemnik sklene ob najemu. Če dodatno zavarovanje ni sklenjeno, najemnik prevzema odgovornost za kolo v skladu s temi pogoji.

If the lessor offers additional insurance for damage or theft of the bicycle, the renter may take it out at the time of rental. If no additional insurance is taken out, the renter assumes responsibility for the bicycle in accordance with these terms.

10. Odpoved najema / Cancellation

Najem je mogoče odpovedati najpozneje 3 dni pred dogovorjenim terminom brez dodatnih stroškov, razen če so že nastale posebne obveznosti ali stroški, povezani z najemom.

The rental may be cancelled no later than 3 days before the agreed rental date without additional costs, unless specific obligations or costs related to the rental have already occurred.

11. Reševanje sporov / Dispute resolution

Stranki bosta morebitne spore reševali sporazumno. Če sporazumna rešitev ni mogoča, je za reševanje sporov pristojno stvarno pristojno sodišče v Celju.

The parties shall resolve any disputes amicably. If an amicable solution is not possible, the competent court in Celje shall have jurisdiction.

12. Končne določbe / Final provisions

Ti pogoji začnejo veljati z dnem podpisa oziroma potrditve najema. Pogodba se dodatno fizično podpiše na lokaciji prevzema kolesa, pred izročitvijo kolesa najemniku. S podpisom dokumenta oziroma prevzemom kolesa najemnik potrjuje, da je seznanjen s pogoji najema in jih v celoti sprejema.

These terms enter into force on the date of signing or confirmation of the rental. The contract shall also be physically signed at the bicycle pick-up location, before the bicycle is handed over to the renter. By signing this document or by taking over the bicycle, the renter confirms that they are familiar with the rental terms and fully accepts them.
